by These Terms of Service (“Terms”) constitute a binding contract between the author, who sign up on the Connect website and submits articles to be hosted on the Connect website (hereinafter referred to as the “Contributor”), the user who signs up on the Connect website to read the articles (hereinafter referred to as “Reader”); and BuildNext Management Solutions Private Limited (hereinafter referred to as “Connect”). The Contributor and the Reader shall collectively be referred to as “User”. The Terms govern the User’s use of Connect sites, services, mobile apps, products, and content (together, the “Services”).
The User agrees to these Terms for using Connect website and underlying Services offered. Accordingly, the User will not be able to use Connect website or the Services if they do not agree to the Terms.
Connect is authorized to modify the terms at its sole discretion. If there is a substantial change in Terms, Connect will inform the User before it takes effect. The User’s use of the site, content, and Services offered by Connect will be subject to the updated policy from the day it becomes effective. The User’s acceptance to the Terms e at the time of sign up (creation of a Connect account) will be considered as consent to the updated Terms as may be updated from time to time. If the User does not agree to the updated Terms, he/she may choose to delete their account.
Content rights & responsibilities
The content includes the articles created or posted in the Connect site and the images, reference links and, hyperlinks used along with the article.
The Contributor owns the rights to the content created and posted on Connect.
By posting content to Connect, the Contributor gives Connect a non-exclusive, perpetual, royalty-free license to publish it on Connect Services or Platforms (including social media) and to do other ancillary acts at Connect’s discretion. In consideration for Connect granting the Contributor access to and use of the Services, the Contributor hereby agrees that Connect may enable advertising and other revenue generation program on the Services such as videos, podcasts including in connection with the display of his/her content. The Contributor explicitly consents to the usage of his content in the manner specified in these Terms. The content including its product and content may be used to promote any of the partners/ advertisers on Connect or the platform or BuildNext in ways that are necessary and applicable. Connect will never sell the contributor’s content to third parties without his/her prior permission.
The Contributor is responsible for the content edited and published in the Connect platform. He/she will assume all risks relevant and related to it, including a reader’s reliance on its accuracy or claims. The Contributor has all the claims relating to intellectual property or other legal rights associated with content posted by him.
The Contributor can post content on Connect that he/she has published elsewhere, as long as the Contributor has the right to do so. It is the Contributor’s responsibility to assure Connect that he/she has the requisite authority or right to post the content on Connect, regardless of whether it is an unpublished content or content that has been already published elsewhere. In cases where the content has already been posted elsewhere, the Contributor needs to ensure that posting it on Connect does not conflict with the Contributor’s agreement of service with any other platforms including journals, online forums, blogs, or any other platforms and Connect will not be liable for any losses or claims arising from that matter. The Contributor agrees to indemnify Connect from any such claims.
By posting content, the Contributor not specifically created for Connect, the Contributor represents and warrants that they have the right to do so. For example, if the Contributor posts a work that is in the public domain, used under license (including a free license), or for fair use, the photos, images, illustrations, etc. used by him should be properly attributed and it is the Contributor’s responsibility to make sure that the content he/she posts is not violating any copyright laws.
Also by posting content on Connect, the Contributor grants permission to Connect or its editors to edit the content to suit the relevance of the Connect readership and presentation of content, including creating headings or subheadings add or remove images suiting the content. The Contributor has the right to remove the content from the platform or request Connect to remove it from the platform if such edits are not acceptable.
Connect can remove any content posted on its website(s) without citing any reason.
After a Contributor’s content is published, if he/she needs to delete his/her post or account; the request needs to be approved by Connect and its editor, and in such a case, the content already published by the Contributor will be available in the Connect database and Connect can use all or part of the content if required in adherence with the Terms. Processing the deletion of the account may take up to 21 days. Connect may keep backup copies of the contributor’s deleted post or account on our servers as long as that is deemed necessary after the contributor’s account is deleted in compliance with applicable laws.
The Contributor shall not post any content that:
a) belongs to another person and to which the Contributor does not have any right to;
b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
c) harm minors in any way;
d) infringes any patent, trademark, copyright or other proprietary rights;
(e) violates any law for the time being in force;
f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
g) impersonate another person;
h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
i) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.
Our content and services
BuildNext Management Solutions Private Limited reserve all rights in Connect websites’ (connect.buildnext.in) look and feel. Parts of Connect website may be licensed under third-party open-source licenses. Connect also make some of their code available under open source licenses. As for other parts of Connect, the Contributor or any party related to the Contributor, shall not copy, adapt or replicate any portion of Connect code or visual design elements (including logos) without express written permission from BuildNext Management Solutions Private Limited. The Contributor should assume that all the parts of the Connect website are licensed to Connect and should seek prior written consent fro Connect if he/she seeks to use any part of the website.
The contributor shall not do, or cause to be done the following acts: (1) access or tamper with non-public areas of the Services of Connect’s computer systems or the systems of Connect’s technical providers; (2) access or search the Services by any means other than the currently available published interfaces (e.g., APIs) that Connect provide; (3) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive, or false source-identifying information; or (4) interfere with or disrupt, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of content or accounts in such a manner as to interfere with or create an undue burden on the Services.
Crawling the Services is allowed if done in accordance with the provisions of the Connect robots.txt file, but scraping the Services is prohibited.
Connect may change, terminate, or restrict access to any aspect of the service, at any time, without any notice.
Users acknowledge and agree that third party websites, advertisements, and services are not under the control of Connect and that Connect is not responsible for the information, content, products, services, advertising, or other materials that may be provided on the Connect website and the Services.
Feedback
If the Contributor has any feedback on any aspect of the Connect website including its system security, he/she may inform Connect about the same. Connect constantly endeavors to leverage user feedback to improve its services with an aim to provide the best service in the industry.
Incorporated rules and policies
By using the services, the User consents to let Connect collect and use information as detailed in Connect’s privacy policy and as may be collected while signing up or through the various forms that are present on the Connect website from time to time. By signing up on the Connect platform, the User agrees to let Connect store, transfer, or use the data (including his/her personal information and content) in or outside India, subject to applicable laws.
To enable a functioning community, Connect has set out certain rules. To ensure that the usernames are distributed and used fairly, Connect has a Username Policy. Under our Copyright Policy, Connect may remove infringing material after receiving a take-down notice. Under Connect’s Trademark Policy, it will investigate any use of another trademark and respond appropriately.
By using Connect, the Contributor agrees to follow these rules and policies. In case of misuse of these rules and policies, Connect can remove content, suspend the account, or delete the Contributor’s account.
Miscellaneous
Disclaimer of warranty
Connect provides the Services to the contributor on an as-is basis. He/she may use it at their own risk and discretion. None expressed, none implied. No implied warranty of merchantability, fitness for a particular purpose, availability, security, title, or non-infringement.
Limitation of Liability
Connect disclaims any liability to the Users for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for business losses, damage to goodwill or reputation that arise from or related to the use, inability to use, performance or failure of the Connect website or the Services.
No waiver
Connect’s failure to exercise a particular right under these Terms does not amount to a waiver of that right or any other right under these Terms.
Severability
If any provision of these Terms is found invalid by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
Choice of law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. The User agrees to submit to the sole jurisdiction of the courts of Ernakulam, Kerala, India
Entire agreement
These Terms (including any document incorporated by reference into them) comprise the whole understanding between Connect and the User concerning the Connect website and the Services.
